1. Acceptance of Terms

By accessing, browsing, or using any part of postiz.bluelime.cloud (“the Service”, “we”, “us”, or “our”), you confirm that you have read, understood, and agree to be legally bound by these Terms of Service (“Terms”), as well as our Privacy Policy, which is incorporated herein by reference. If you do not agree to all of the Terms set forth in this document, you must immediately cease use of the Service and are not permitted to access or use it in any manner.

These Terms constitute the entire agreement between you and the operator of this Service with respect to your use of the Service, and supersede all prior or contemporaneous understandings, communications, or agreements, whether written or oral. The operator reserves the right to amend these Terms at any time at their sole discretion, and your continued use of the Service after any such amendment constitutes your acceptance of the revised Terms.

2. Description and Nature of the Service

postiz.bluelime.cloud provides a self-hosted interface for managing, scheduling, and publishing content to connected social media accounts. The Service operates using the open-source Postiz application, deployed and maintained by a private individual for strictly personal, non-commercial, and hobby use. The Service is not a commercial product, does not charge users any fees, does not serve advertisements, and is not offered to the public at large as a platform or subscription service.

The Service acts as a technical intermediary, facilitating the scheduling and publication of user-generated content to third-party social media platforms — including but not limited to TikTok, Instagram, LinkedIn, Twitter/X, Facebook, and YouTube — through their respective official APIs. The operator of this Service neither endorses nor assumes responsibility for any content published to third-party platforms through the Service.

Access to this instance is strictly limited and is not available through open public registration. Any individual granted access has been explicitly authorized by the administrator of this personal, privately operated instance.

3. Eligibility

You must be at least 13 years of age to access or use the Service. By using the Service, you represent and warrant that you are at least 13 years old, that you have the full legal capacity and authority to enter into and comply with these Terms, and that you are not prohibited from receiving services under any applicable law. If you are accessing the Service on behalf of another person or entity, you further represent that you have the legal authority to bind them to these Terms.

4. Personal and Non-Commercial Use Only

The Service is operated strictly for personal, non-commercial, hobby purposes by a private individual. Any access granted to other users is likewise intended for personal use only. You agree that you will not use the Service for any commercial purpose, including but not limited to: operating the Service as a platform for third parties, reselling or sublicensing access to the Service, using the Service to generate revenue directly or indirectly, or using the Service to conduct any business operation without the explicit prior written consent of the operator.

This non-commercial restriction is fundamental to the nature of this Service and to its compliance with the developer platform policies of third-party APIs to which it connects. Any violation of this restriction will result in immediate termination of your access to the Service.

5. User Responsibilities and Acceptable Use

By using the Service, you agree to use it responsibly, lawfully, and in accordance with these Terms and all applicable local, national, and international laws and regulations. You specifically agree that you will not:

• Use the Service to upload, publish, schedule, or transmit any content that is unlawful, harmful, defamatory, obscene, threatening, harassing, abusive, invasive of another person’s privacy, or otherwise objectionable.
• Use the Service to infringe upon the intellectual property rights, privacy rights, or any other rights of any third party, including rights in copyrighted content, trademarks, trade secrets, or personal data.
• Attempt to gain unauthorized access to the Service, its server infrastructure, the administrator’s accounts, or any connected third-party platform accounts that you are not explicitly authorized to access.
• Use the Service to distribute spam, unsolicited messages, phishing content, malware, or any other harmful or deceptive material through connected social media platforms.
• Reverse-engineer, decompile, or attempt to extract the source code or internal logic of any proprietary components of the Service, beyond what is permitted by applicable open-source licenses.
• Use the Service in any manner that could damage, disable, overburden, or impair the server infrastructure or interfere with the ability of any other authorized user to access the Service.
• Violate the terms of service, community guidelines, or developer platform policies of any third-party platform to which you connect through this Service.

The operator reserves the right to suspend or terminate your access to the Service immediately and without prior notice if you are found to be in breach of any of the above acceptable use requirements.

6. Third-Party Platform Compliance

By using the Service to connect to and interact with third-party social media platforms, you acknowledge and agree that: (a) you are solely responsible for ensuring that your use of each connected platform complies with that platform’s own terms of service, developer policies, community standards, and applicable laws; (b) the operator of this Service does not control, monitor, or guarantee the actions, availability, or policy decisions of any third-party platform; and (c) changes to third-party platform APIs, terms of service, or developer access policies may affect the functionality of this Service at any time and without advance notice to the operator.

You also agree not to use the Service to interact with any third-party platform in a way that violates that platform’s developer terms of use, including excessive API calls, automated behavior that mimics human interaction beyond what the platform’s API expressly permits, or any other usage pattern that could jeopardize the API access of this Service.

7. Intellectual Property

You retain full ownership of and all rights to any content you create, draft, upload, or publish through the Service. The Service does not claim any ownership, license, or rights over your content beyond what is technically necessary to transmit it to the third-party platforms you have designated. You represent and warrant that you own or have all necessary rights and permissions to publish any content you submit through the Service to the connected platforms.

The underlying Postiz software used to operate this Service is open-source software and is subject to its respective open-source license. The operator of this Service does not claim ownership of the Postiz software itself. References to third-party brand names, trademarks, and platform names within this Service are used purely for descriptive purposes and do not imply any affiliation with or endorsement by those brands or platforms.

8. Availability and Modifications

The Service is provided on a best-effort basis and may experience downtime, interruptions, or reduced functionality without prior notice. As a personal hobby project maintained by a single individual, the operator does not guarantee any specific level of availability, uptime, response time, or continuity of service. Maintenance, updates, technical issues, or changes to third-party platform APIs may result in temporary or permanent unavailability of certain features.

The operator reserves the right to modify, suspend, restrict access to, or permanently discontinue all or any part of the Service at any time and for any reason, without prior notice and without liability to any user. You acknowledge that the operator has no obligation to maintain the Service indefinitely or to provide advance notice of any such changes.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, OR UNINTERRUPTED OPERATION. No advice or information, whether oral or written, obtained from the operator or through the Service shall create any warranty not expressly stated in these Terms.

The operator does not warrant that the Service will be secure, error-free, free of viruses or malicious code, or that any defects will be corrected. Your use of the Service is at your own risk and your sole responsibility.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, INCLUDING BUT NOT LIMITED TO: LOSS OF CONTENT, LOSS OF DATA, LOSS OF REVENUE OR PROFIT, LOSS OF GOODWILL, PERSONAL INJURY, OR PROPERTY DAMAGE, EVEN IF THE OPERATOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Because this is a free, personal, non-commercial hobby project, the total aggregate liability of the operator arising out of or related to your use of the Service shall not exceed zero euros (€0), to the extent permitted by applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless the operator and administrator of this Service from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law, regulation, or third-party right, including intellectual property rights or privacy rights; or (c) any content you publish or attempt to publish through the Service to any connected social media platform.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of laws principles that would require the application of the laws of a different jurisdiction. Any dispute arising out of or in connection with these Terms or your use of the Service shall first be attempted to be resolved informally by contacting the operator at the email address provided. If informal resolution is not possible, disputes shall be submitted to the competent courts of the jurisdiction in which the operator is located.

14. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions of these Terms shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it enforceable, while preserving the original intent of the parties to the greatest extent possible.
